General Terms and Conditions for Contracting, Access to and Use of Fast Wash Services

Introduction and Purpose of the Agreement

These General Terms and Conditions for Contracting, Access to and Use of FAST WASH Services (the “General Terms and Conditions”) govern the contractual relationship between FAST WASH CAR WASH S.L. (“FAST WASH”), with registered office at Carrer del Ciment 13, 08800 Vilanova i la Geltru, Barcelona, Spain, and Spanish Tax Identification Number (NIF) B56499536, and the natural or legal person who contracts, accesses or uses its services (the “User” or the “Customer”).

These General Terms and Conditions, together with the specific terms, the subscription plan selected, the applicable rate, any applicable promotions, and any registration form or electronic acceptance form, constitute the legally binding agreement between the User and FAST WASH (the “Agreement”).

The contracting or use of the services implies that these General Terms and Conditions have been read, understood and accepted, without prejudice to any rights granted to the Customer under consumer and user regulations where applicable.

1. Scope of Application

These General Terms and Conditions apply to all washing services, subscriptions, promotions, access, use of facilities, digital platforms and commercial communications offered by FAST WASH, unless specific terms expressly accepted by the User prevail for a particular promotion, campaign or service.

2. Definitions

User or Customer: the person who contracts, accesses or uses FAST WASH services, whether as the holder of a subscription, an occasional user or an authorized beneficiary.

Subscription: a recurring contracting arrangement that allows access to certain included services during the relevant billing period.

Plan or Modality: the commercial category contracted by the User, such as Basic, Super or Premium, or any other category that FAST WASH may offer in the future.

Authorized vehicle: the vehicle communicated by the User and accepted by FAST WASH for use of the contracted service.

Billing period: the monthly period or any other period indicated in the specific terms of the contracted modality.

3. Formation of the Agreement

The Agreement may be formalized in person at FAST WASH facilities, by electronic means, through the website, mobile application, self-service terminal, payment platform or any other channel enabled by FAST WASH.

The User declares that the information provided during the contracting process is true, complete and up to date. FAST WASH may request reasonable documentation to verify the User’s identity, ownership of or authorization to use the vehicle, and the validity of the payment method.

In electronic contracting, the User shall expressly accept these General Terms and Conditions by means of an acceptance checkbox, digital signature, purchase confirmation or equivalent procedure. FAST WASH may retain electronic evidence of such acceptance.

4. Subscription Modalities and Included Services

FAST WASH may offer different subscription modalities and one-off services. The specific services, prices, limitations and applicable promotions shall be those communicated at the time of contracting and may be reflected on the website, in the application, on signage, in the registration form or on the purchase receipt.

4.1 BASIC Modality

Basic exterior wash. Includes quick exterior cleaning with soap, wax, osmosis rinse and drying, subject to the technical availability of the tunnel or washing system.

4.2 SUPER Modality

More complete exterior wash. Includes additional services such as full high pressure, underbody wash, wheel-rim wash and foaming wax, in accordance with the current operating configuration.

4.3 PREMIUM Modality

Superior full wash. Includes a complete wash with triple foam, ceramic wax, tire shine, anti-corrosion underbody treatment and extra brush drying, always subject to equipment availability and compatibility with the vehicle.

4.4 Reasonable Use Limits

Subscriptions are intended for personal, ordinary and reasonable use of the service. Unless expressly agreed in writing, subscriptions may not be used for fleets, taxis, private-hire vehicles (VTC), rental vehicles, resale, intensive commercial use or washing third-party vehicles.

FAST WASH may establish technical or operational usage limits, schedules, a reasonable frequency of washes, license-plate control, vehicle identification and anti-fraud measures, always in a proportionate manner and with the aim of ensuring service quality and continuity.

5. Rates, Promotions and Plan Changes

The applicable rates shall be those communicated to the User before contracting. Prices may include temporary promotions, launch discounts, agreements with collaborating entities or special conditions subject to availability and to the terms of each campaign.

The User may request a plan change in accordance with the procedures enabled by FAST WASH. Changes may be applied in the next billing cycle or immediately where the system allows, with the corresponding financial adjustment where applicable.

Promotions shall not be cumulative unless expressly stated. FAST WASH may end or modify future promotions without affecting rights already acquired by the User in accordance with applicable law.

6. Payments, Authorization for Recurring Charges and Billing

For monthly subscriptions, FAST WASH accepts automatic recurring charges to a valid credit or debit card as the payment method, or any other methods that FAST WASH may expressly enable in the future.

The User expressly authorizes FAST WASH to make the recurring charges corresponding to the contracted subscription to the card or payment method provided. Charges shall be made at the beginning of each billing period or on the date indicated during contracting.

The User declares that he or she is authorized to use the payment method provided, that the details are correct, and that he or she shall keep that payment method active and with sufficient funds throughout the term of the Agreement.

In the event of rejection, chargeback or inability to collect payment for reasons attributable to the User, FAST WASH may temporarily suspend access to the services, retry collection, claim outstanding amounts and pass on actual, verifiable and reasonable bank charges arising from non-payment.

Cancellation, blocking or expiry of the card shall not imply automatic cancellation of the subscription. The User must process cancellation in accordance with the procedure set out in these General Terms and Conditions.

7. Term, Renewal and Cancellation of the Subscription

Unless the specific terms indicate otherwise, subscriptions shall have a monthly term and shall renew automatically for successive periods of the same duration, unless the User requests cancellation in accordance with the established procedure.

The User may cancel his or her subscription by written notice addressed to FAST WASH, through the contact email address, the enabled platform or in person at the center, with at least ten (10) calendar days’ prior notice, unless applicable law or the specific terms establish a more favorable period for the User.

Cancellation shall take effect at the end of the current billing period or on the date corresponding to the applicable notice period. Fees already accrued shall not be refundable except where required by law, in the event of an error attributable to FAST WASH, or under an express promotional condition stating otherwise.

FAST WASH may cancel or suspend the subscription for serious breach by the User, fraudulent use, non-payment, unauthorized transfer, damage to facilities, inappropriate behavior or use contrary to service safety, with prior notice where reasonable and without prejudice to claiming damages or outstanding amounts.

8. Right of Withdrawal

Where the Agreement has been concluded at a distance or away from business premises, a User who qualifies as a consumer may exercise, where legally applicable, the right of withdrawal within fourteen (14) calendar days from contracting, in accordance with the applicable regulations on consumers and users.

To exercise the right of withdrawal, the User must communicate his or her decision clearly and unequivocally to FAST WASH using the form included as Annex I or by any equivalent written communication sent to info@fastwashcarwash.com.

If the User expressly requests or accepts the start of the service during the withdrawal period, FAST WASH may deduct or charge the proportional part corresponding to the services actually provided, where permitted by law.

9. Modification of Prices and Conditions

FAST WASH may modify rates, services or conditions for objective reasons, including increases in operating costs, tax or regulatory changes, service improvements, technological developments, market variations or organizational needs.

Modifications affecting active subscriptions shall be communicated with reasonable advance notice. If the User does not accept a substantial modification, the User may cancel the subscription before the modification becomes applicable, without penalty and without prejudice to any rights recognized by applicable law.

10. Conditions for Access to and Use of the Facilities

·       The User must respect the rules of use, signage, staff instructions, safety indications, speed limits, waiting areas and operating protocols of the center.

·       The User must place the vehicle in the indicated position, remove or fold external elements where appropriate, close windows, sunroof and doors, deactivate automatic windshield wipers and follow instructions before, during and after the wash.

·       Access to the washing system is not permitted for vehicles with leaks, breakdowns, loose parts, improperly secured accessories, incompatible modifications, excessive load, inadmissible dimensions or any condition that may compromise safety.

·       The User shall be responsible for damage caused by failure to follow instructions, improper use of the service or an unsuitable condition of the vehicle.

11. Condition of the Vehicle, Accessories and Limitations of Liability

FAST WASH shall provide the service with professional diligence and in accordance with the established operating procedures. However, the User acknowledges that certain damage may arise from the prior condition of the vehicle or from elements that are incompatible with an automated washing system, and is therefore required to follow all company instructions.

FAST WASH shall not be liable for damage arising from pre-existing defects, deteriorated paintwork, defective repairs, loose trim or antennas, damaged mirrors, non-original accessories, roof racks, bicycle racks, vinyl wraps, stickers, sensors, cameras, poorly secured external or internal objects, or any element that is not in suitable condition for washing. FAST WASH is responsible for damage caused by malfunction, negligence, or lack of professional diligence.

The User must inform staff of any relevant circumstance before starting the service. FAST WASH may refuse to wash vehicles that, in the reasonable judgment of staff, are not safe or compatible with the system.

12. Personal Belongings

The User is responsible for removing or securing personal belongings, documents, electronic devices, money, keys, cards, valuables, accessories and any property located inside or outside the vehicle. FAST WASH shall not be liable for loss, theft or deterioration of items left in the vehicle or on the premises, except where liability is legally enforceable.

13. Claims and Incidents

Any incident related to the service must be communicated to FAST WASH immediately and, whenever possible, before leaving the premises, in order to allow review of the vehicle, facilities, cameras, operating records and any other relevant elements. All of the foregoing is without prejudice to the consumer’s legal rights.

Claims may be submitted in person, by email to info@fastwashcarwash.com or through the channels enabled by FAST WASH. The User must provide identification, license plate number, approximate date and time, a description of the facts, photographs and any documentation useful for analyzing the incident.

14. Civil Liability and Insurance

FAST WASH maintains civil liability coverage in accordance with its legal and operational obligations. The existence of insurance does not imply automatic recognition of liability, which shall be determined on a case-by-case basis in accordance with the facts, available evidence, service conditions and applicable law.

15. Force Majeure and Service Interruptions

FAST WASH shall not be liable for delays, interruptions or temporary inability to provide the service where these are due to force majeure, breakdowns, maintenance, supply outages, technical incidents, weather conditions, administrative restrictions, emergencies, vandalism or circumstances beyond FAST WASH’s reasonable control.

Where possible, FAST WASH shall endeavor to inform Users of relevant closures or interruptions and to restore the service within the shortest reasonable time. Any compensation, where applicable, shall be assessed according to the duration of the interruption, the type of subscription and applicable law.

16. Personal Data Protection

FAST WASH shall process the User’s personal data in accordance with Regulation (EU) 2016/679 (GDPR), Organic Law 3/2018 on Personal Data Protection and guarantee of digital rights, and all other applicable regulations.

Data may be processed to manage the contractual relationship, registrations and cancellations, payments, billing, customer service, access control, security, fraud prevention, incident management, compliance with legal obligations and, where applicable, the sending of authorized commercial communications.

The User may exercise his or her rights of access, rectification, erasure, objection, restriction and portability by written communication to FAST WASH at info@fastwashcarwash.com, indicating the right he or she wishes to exercise and providing the information necessary to verify his or her identity.

FAST WASH must provide the User with a complete and up-to-date privacy policy detailing the controller, purposes, legal bases, retention periods, recipients, processors, transfers, rights and complaint channels.

17. Video Surveillance

The facilities may have video surveillance systems for security, operational control, incident prevention and the protection of people, property and facilities. The capture and retention of images shall be carried out in accordance with applicable regulations and with the information provided through visible signage and the privacy policy.

18. Communications

Communications between FAST WASH and the User may be made by email, telephone, SMS, WhatsApp or other electronic channels, mobile application, customer area, in-person communication or any reasonable means provided by the User or enabled by FAST WASH.

The User undertakes to keep his or her contact details up to date. Communications sent to the details provided by the User shall be deemed valid unless there is an error attributable to FAST WASH or prior communication of a change in details.

19. Use of the Website, Application and Cookies

The use of the FAST WASH website, mobile application or digital platforms may be subject to specific terms of use, privacy policy and cookie policy. FAST WASH shall use technical cookies and, where applicable, analytics or advertising cookies in accordance with the consent and settings applicable at any given time.

The User must use the platforms lawfully, diligently and in accordance with their purpose, without manipulating systems, credentials, promotions, codes, license plates, access or payment processes.

20. Assignment of the Subscription and Use by Third Parties

The subscription is personal and non-transferable, unless expressly authorized by FAST WASH or unless specific terms permit use by several vehicles or users. The User may not resell, assign, lend or share the subscription with unauthorized third parties.

FAST WASH may link the subscription to a license plate, user, card, code, tag, account or equivalent identification system. Any irregular use may result in suspension or cancellation of the service.

21. Severability

If any clause of these General Terms and Conditions is declared null, invalid or unenforceable, such circumstance shall not affect the validity of the remainder of the Agreement. The affected clause shall be interpreted or replaced by another valid clause that comes as close as possible to the intended purpose, always in accordance with applicable law.

22. Applicable Law and Jurisdiction

This Agreement shall be governed by Spanish law. Where the User qualifies as a consumer, disputes shall be submitted to the courts and tribunals that correspond in accordance with consumer and user regulations. In all other cases, the parties may submit to the competent courts and tribunals in accordance with applicable procedural law.

23. Customer Acceptance

By signing, electronically accepting, contracting or using the services, the User acknowledges having read and understood these General Terms and Conditions, accepts their content and authorizes, where applicable, the recurring charges corresponding to the contracted modality.
